Lori LaFond just can't stop herself! She just said so. How I feel about what she just said is called my state of mind! This legal concept has to do with my behavior during the commission of a crime. What did Lori Jean Marie LaFond say to put me in fear for my life? Did she tell me I had to rob a bank or she would kill my family? Did she tell me that my boyfriend of 16 years was cheating on me with fake text messages? Did she call my work and lie about me? Did she spread a rumor about me that cost me my home?
These factors are all part of a person's state of mind, and simply thinking something DOES NOT constitute a crime! Lori thinks that it does. It's a real problem to go from mens rea to actus rea; it's a bridge that is crossed and that usually has to do with a person's state of mind. If the person was put in reasonable fear for his life or the life of his loved ones (this can also apply to a minority community like ours), then the actions taken have to do with who started building that bridge in the mind of the person who committed the act. The instigator is just as guilty as the person who committed the act. This is defensible through the concept of state of mind.
Through that microphone comes years of sleep deprivation and negativity. Threats of all kinds. Some that came true, like putting Anthony and Christopher in jail. Some that focus on my family members after Lori already proved that she knew where they were and that she had been there before. Lori's words and actions build the bridge of a fearful state of mind that delivers you from mens rea to actus rea. If not for Lori LaFond, that bridge would never have existed... therefore, she is guilty of instigating the crime that occurred without guilt being placed on the person. If we can prove something like "blackmail" or "extortion" existed, that can defend a person's actions.
For example, if Lori told Christopher to rob a bank to save his mother's home from being set on fire like Christopher and Tracy's home, then Christopher, who has seen Lori try and succeed at these things, might be put in a reasonable amount of fear and use impaired judgment, leading up to robbing a bank to save his mother. Lori uses the "mad bomber" approach all the time. She threatens us with financial ruin or health infections of our elderly and minors. Sometimes she even kills puppies. Dogs. Cats. Whatever the person she is targeting loves, Lori wants to kill it.
