Sen. Connie Leyva and Gov. Jeffy Brown Introduce Justice for Victims Act SB 813 Protecting Rape Victims


Finally there is a reason for victims of sexual assault to be somewhat thankful for Bill Cosby, in a way.  The new bill, SB 813 will lift the ban on statute of limitations for rape victims to bring a case against their rapists.  You will recall, Mr. Cosby here, not unlike our Blue Widow, is accused of using date rape drugs to knock out a number of women, in our case gay men, over the last thirty years to "have sex with them".  In our case the men and women were intentionally infected with HIV.  Many of our cases are way over ten years old.   Without DNA evidence, under the current law, cases that old would prevent those victims from bringing a case against the Blue Widow, would fall under the statute of limitations.  Here's the problem for the Blue Widow that she never thought of.

In most DNA cases of rape, they rely heavily on bodily fluids, semen or saliva, for that DNA to be used against the victim.  In our case, there would never be any semen...the Blue Widow is a woman and doubtful that any of these men would have reported a rape because they didn't know they had been raped until months later when they tested positive for HIV.   Perfect crime?  Then maybe, not now.  DNA can now be extracted from the HIV virus that can not only be matched to the criminal rapist, but can be traced to the person that infected them.  Gay men don't have sex with women very often if ever and most will say they've never met the Blue Widow...for them to have been infected by a woman they've never met, impossible.   The new bill allows for any statute of limitations to be lifted even without DNA evidence which allows for much easier prosecution.

It is important to note that the Blue Widow uses this technology to blackmail these gay men into silence by using their own sexual history to try to keep them quiet as if they, themselves, had done what she did.  Not one of these victims intentionally went out and infected then implanted 600 gay men then stalked them for the rest of their lives.  If anything most of them didn't know they were infected for a long time and had no idea that they even could have been.  It is a very traumatic experience to KNOW you couldn't have HIV, then find out you do.  None of these men or women need to be put through their "sexual past" bullshit when clearly they should be protected by the "rape shield laws" there to protect them.
